Terms of service These terms govern your use of saintesenswings.com and any purchase you make from it. The store is operated by 2 Willen 2 Ecommerce LP. By using the site or placing an order you agree to these terms. THE STORE We sell the Saint Esen Sensory Swing to customers in the United States. We may change products, prices and availability at any time. We try to describe everything accurately, but we do not warrant that every description, photo or measurement on the site is free of error. Colors vary between screens. ORDERS Placing an order is an offer to buy. We may refuse or cancel any order, including after you receive a confirmation, for reasons such as a pricing error, suspected fraud, or an address we cannot ship to. If we cancel an order you have paid for, we refund it in full. Prices are in US dollars and exclude sales tax, which is calculated at checkout where it applies. PROMOTIONS AND DISCOUNT CODES Discount codes apply to one order, cannot be combined unless we say so, have no cash value, and can be withdrawn at any time. Welcome codes are for first orders. SAFE USE OF THE SWING This is important, and it is a condition of use. - The swing is intended for people aged 3 and over. Adult supervision is required at all times. - Maximum load is 200 pounds, with one person in the swing at a time. - Mount the swing only to a wood ceiling joist, a suitable concrete ceiling, a sturdy living tree branch, or a play set beam rated for a swing. Never mount it to drywall alone, to a ceiling tile, or to any surface that is not structural. - Pull firmly on the installed swing to test it before every use, and inspect the fabric, the strap, the carabiner and the ceiling mount before every use. - Keep at least three feet of clear space around the swing in every direction, including the full circle it can reach when it spins. - Follow the installation and care instructions supplied with the swing and published on our Installation guide page. The swing is a consumer product for home use. It is not a medical device, and nothing on this site is medical advice. We make no medical claims about it, and it is not intended to diagnose or treat any condition. Talk to a qualified professional about your own situation. To the fullest extent permitted by law, 2 Willen 2 Ecommerce LP is not liable for injury or damage arising from installation that does not follow our instructions, from use outside the limits above, from a lack of supervision, or from continued use of a swing showing wear or damage. INTELLECTUAL PROPERTY The Saint Esen name, logo, site content, photography and copy are ours or are licensed to us. You may not copy, republish or use them commercially without written permission. USER CONTENT If you send us a review, a photo or a comment, you give us permission to use it in connection with our products and marketing, with attribution to the name you supplied. You confirm the content is yours to give and does not break any law. LIMITATION OF LIABILITY To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages. Some jurisdictions do not allow these limits, in which case they apply to the fullest extent that jurisdiction allows. INDEMNITY You agree to indemnify 2 Willen 2 Ecommerce LP against claims arising from your breach of these terms or your misuse of the swing. GOVERNING LAW These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California. CHANGES We may update these terms.
